Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before purchasing or accessing any services, coaching programs, content, or communities provided by Avery Cadogan (doing business as ARC English) (“we”, “our”, or “us”).

By enrolling in or purchasing any of our programs, you (“you”, “the user”, “the student”) agree to be bound by the following Terms.

1. Eligibility

By using our services, you confirm that you are at least 18 years old and legally able to enter into a binding contract.

2. Program Access and Use

Your purchase grants you limited, non-transferable access to the coaching program or community platform for the duration specified in your selected plan. You agree not to share, sell, reproduce, or redistribute any course content without written permission.

3. Recurring Billing and Payment Terms

By enrolling in a paid plan, you:

  • Authorize us to charge your payment method on a recurring basis, according to the billing cycle (e.g., monthly, every 90 days) of the plan you selected.

  • Agree that this subscription will automatically renew unless you cancel before the next billing cycle.

  • Acknowledge that you are responsible for cancelling your subscription if you no longer wish to be charged.

  • Consent to being charged automatically until cancellation, without additional notice, unless otherwise required by law.

4. No Refund Policy

Due to the digital nature of our products, services, and coaching time:

  • All sales are final. No refunds will be issued, including for unused time, missed sessions, or change of mind.

  • We do not offer partial refunds, regardless of participation level or performance.

5. Cancellation

You may cancel your subscription at any time through your user account or by contacting us at the support email below. Cancellations take effect at the end of the current billing cycle, and you will not receive a refund for any remaining days in the cycle.

6. Intellectual Property

All content provided in the course or community (videos, PDFs, recordings, posts, etc.) is the intellectual property of Avery Cadogan (d.b.a. ARC English) and may not be copied, republished, or distributed without explicit written permission.

7. Community Conduct

You agree to:

  • Treat all other users with respect

  • Not engage in harassment, spam, or inappropriate behavior

  • Follow all community rules as outlined in our welcome materials

We reserve the right to remove any member who violates these rules, without refund.

8. Limitation of Liability

We are not liable for any direct, indirect, incidental, or consequential damages resulting from your use of or inability to use our services. All results from coaching and participation depend on your personal effort, consistency, and engagement.

9. Changes to Terms

We reserve the right to update or modify these Terms at any time. Any changes will be posted on this page, and continued use of our services constitutes acceptance of those changes.

10. Pricing Disclaimer

All prices for programs, coaching, community access, and services are subject to change at any time. Any price changes will not affect existing active subscriptions for the remainder of the current billing cycle, but may apply upon renewal. We reserve the right to introduce new pricing tiers, discounts, or offers at our sole discretion.

11. Data Collection

By using our services, you acknowledge and agree that we may collect, store, and process information you provide, including but not limited to your name, email address, device information, activity within our platform, communication records, quiz/test performance, and user feedback. This information may be used to improve our services, personalize your experience, and for other business-related purposes.

We take commercially reasonable steps to protect your data and operate in accordance with applicable data protection laws. By continuing to use our services, you consent to such collection and use.

12. Information Use and Sale

We reserve the right to use, analyze, share, or sell aggregated or anonymized user data at our sole discretion. This may include providing insights to third parties, creating derivative works, or engaging in commercial partnerships. Personally identifiable information will not be sold or shared in a way that directly identifies you without your explicit consent, unless required by law or necessary to operate our services (e.g., through email providers or analytics tools).
